Terms of Service

​

If you would like to work on a project together, please make sure to read this and this page (Terms of Service) very carefully. Thank you.

​

If I'm giving out slots, it means I can give you a price quote and a rough estimate of the time when the work can commence. I don't give out slots months ahead, because I can't guarantee I will be available for work.

General
  1. By sending me (“I”, “me”, “the artist”) a commission form, you (“the commissioner”) are agreeing to the following Terms of Service ("ToS"). 
     

  2. Anyone who violates the ToS will be blacklisted. 
     

  3. By sending a mature themed request, the commissioner confirms that they are 18+ years old. If the claim is proven false, the commission is cancelled, no refund will be issued. The commissioner will be blacklisted until they reach 18 and prove their age with an official ID.

The Process
  1. All negotiations and discussion should happen via e-mail, in English. 
     

  2. Commissioners must wait until the official opening and send me a filled google docs form. I only respond to forms that are sent to me while my commissions are open, properly filled.
     

  3. To ensure the highest level of satisfaction, the form should be filled after careful consideration, including every relevant detail and reference.
     

  4. I offer a price quote based on the information in the request form. I start working on the project after payment has been made, but I won't ask for any amount until I can start (latest the following week). Specifics will be discussed privately. 
     

  5. The project can be adjusted to the available budget, but requesting a lower price without shifting the quality and/or other features will result in the cancellation of the commission. 
     

  6. I work in the order of the requests I receive, on a first-come-first-serve basis. If the project has to be prioritised because of a deadline, holiday, birthday, etc, it must be clearly stated in the request form and extra fees may apply. The Priority Fee depends on the scale of the project and the deadline as well.
     

  7. Once I approved a slot, minor changes are acceptable. The concept, theme and references can be changed entirely once per slot, but a new price will be calculated. If the overhaul of the entire project happens more than once, the commission will be cancelled, and the commissioner will need to apply for another slot. 
     

  8. By sending a request form, the commissioner confirms their confidence in their ideas, expresses their willingness to pay for and work on the project, offering their feedback whenever necessary. I am happy to offer my insight if requested, but extensive ideation is not included in the price.
     

  9. If no feedback is received, a project that has been paid for will be put on a halt for two weeks. After two weeks, it will be finished and delivered, no feedback accepted. A 30-day delay can be requested if serious circumstances occur and the commissioner is unable to participate in the project for a while, but such occurrences need to be communicated.
     

  10. If I receive references for a design as guidelines, I will do my best to use those ideas to create something similar but unique, and I can do minor shifting based on the commissioner's feedback. However, more back-and-forth turns this into a design process and therefore extra fees will apply. Naturally, if the character already has their own detailed design which I can "copy" 1:1, this will not be an issue.
     

  11. Copying unique designs and characters that belong to someone other than the commissioner OR a popular media will be refused without exception. I will not change my workflow for specific projects, I will not try to copy the style of other artists, and I will not “re-draw” or “fix” existing artworks. The only exception is if the character lives in a specific universe, a popular title, or if a popular style is preferred by the commissioner: in this case, I’m happy to adapt to the original style if possible. (This only applies to proportions and facial features, not my workflow, and it may come with extra fees.) 
     

  12. I like to include people in the process. The commissioner will be shown progress at different stages, and they may request relevant changes in each stage for free. Things that could have been changed at an earlier stage will be charged for. (eg. if the pose has been agreed upon during the Sketch phase but then needs to be changed after the drawing has been colored.)

    ‣ Sketch: shifting the pose or expression, slightly different outfit, background. After 2 major changes, extra fees will apply. 
    ‣ After the sketching stage: color adjustments, small details. Bigger changes will cost extra. 
    ‣ Mid-/after rendering (if applicable): every change will be charged for. 
     

  13. From start to finish, it usually takes me 1-4 weeks to finish a project, rarely more. This depends heavily on the responsiveness of the commissioner, and the scale and number of the project(s). Any delay or unforeseen circumstances will be communicated.  
     

  14. I keep the right to deny the request if it violates any of my terms, if I don’t feel comfortable with it for any reason or if the commissioner has been reportedly abusing other artists’ terms. 
     

  15. Please remember that in this special field, the artist’s performance depends on their mood and level of inspiration. Delivering a certain quality is very important to me, I would like to take my time with each commission - to a reasonable extent, of course. 

The Product
  1. This is a digital product. The files will be sent in a *.jpg and *.png format. With the rise of art theft, I suggest to refrain from posting the high-resolution image on social media and forums, and sharing a smaller, properly watermarked version instead, which I am happy to provide. 
     

  2. The artworks are made up to 4000px wide/tall and in 300dpi. The pictures are suitable for printing even in A3 size. If not specified, the piece will be made in 4K, portrait/landscape/square, depending on the composition. 
     

  3. Physical copy (print) is NOT included in the order, the printing and shipping costs are not included in the price. These fees vary based on the size and destination. It is good to remember though that the safe shipping of larger items is very likely not worth the price, and it is better to get the picture printed locally. (Please contact me for further details.) 

Copyright and Usage
  1. All projects are made for personal use, unless agreed otherwise. Information regarding commercial art can be found below in the Commercial Projects section.
     

  2. The finished product will have my signature. 
     

  3. I retain the rights to the final product.  
     

  4. I am ALLOWED to:  
    ‣ Claim ownership of any part of the artwork that has been made by me: the art itself, design (if applicable), etc 
    ‣ Share the artwork on my website and social media for promotion purposes 
    ‣ Share Work in Progress pictures on Patreon  
     

  5. I am NOT ALLOWED to:
    ‣ Claim ownership of the content, ie. the character or parts of it that does not belong to me 
    ‣ Monetise any part of the artwork in any way
     

  6. The private commissioner is ALLOWED to:  
    ‣ use the artwork for personal purposes 
    ‣ re-upload it to forums, Discord servers, blog, social media 
    ‣ print the image for personal use 
    ‣ claim their rights to the character or any part of the content if it belongs to them 
    ‣ use the artwork to promote their business (eg. authors) 
     

  7. The private commissioner is NOT ALLOWED to:  
    ‣ change or modify the artwork (except banner and avatar crops) 
    ‣ remove the signature  
    ‣ take credit for the artwork or parts made by me
    ‣ reprint, resell or monetise the product or a part of it in any form 
    ‣ use the artwork for any purpose that has not been discussed 
     

  8. Where it applies (in case of OCs), proper credits of ownership of the character will always be given to the commissioner, unless anonymity is requested. 
     

  9. Proper credits for the artwork and anything I produced (eg. concepts) always need to be given to me, the artist, with at least one social media handle (preferably a link).

Useful terms that appear in this section and how they apply to art/commission projects

  • artwork/picture: a piece of art on a digital canvas; it is physically perceivable (visible), printable, etc

  • design: intangible intellectual property; a plan of the look of outfits, etc; usually presented through an artwork

  • concept: abstract ideas regarding the atmosphere, emotions, etc of the artwork, or the nature/"vibe" of a character

  • content/part: concept, design, character, background, etc

Payment and Refund
  1. I'm only able to accept PayPal and EUR. No other parties, services and currencies should be involved. 
     

  2. I ask for the entire sum upfront. In the cases of unusually large projects (300+ EUR), it is possible to pay 50% upfront and 50% around halfway through the process. 
     

  3. The commissioner has two weeks to make the (first) payment for the project after the price has been agreed upon. After a longer delay, the project will be cancelled.
     

  4. Since it is a custom product, I offer a 100% refund only in cases where I am unable to complete the order.  
     

  5. If the project is cancelled by the commissioner before any work has been done, I am able to offer a 70% refund. 
     

  6. If the project is cancelled at the Sketch stage, I can offer a 40% refund. Once the sketch has been agreed upon, I cannot offer any refund. 
     

  7. If I'm unable to complete a priority project in time out of my negligence, 100% of the priority fee will be refunded, along with 30% of the project fee. If the delay happens because of the lack of response or poor feedback on the commissioner's part, there will be no refund. In cases like this, I will still try to finish the project in time, but I cannot guarantee that the end product will be satisfactory.
     

  8. By sending me a commission form, the commissioner agrees not to request automatic refunds through Paypal. Failing to adhere to this will result in losing every right to the current project, giving me freedom in using and monetising any and all parts of the artwork. Offenders will be excluded from any future activities, will not be able to order anything from me and the case with every detail will be made public.  

Commercial Projects
  1. All projects are automatically made for non-commercial purposes unless agreed otherwise. The usage policy of commercial projects will be discussed separately, on a case-by-case basis. 
     

  2. The following parts apply to Commercial Projects as well: General, Process, Product, Payment and Refund, Themes.
     

  3. A commercial project will cost about 2-3 times more, but this may be subject to change. The price depends on a number of factors, such as the purpose of the artwork.

Copyright Exclusive Rights include:

  • right to control the reproduction of the work (eg. copying the artwork or design, "art theft", etc)

  • right to control the making of derivative works (eg. editing the artwork, creating artworks based on a design, etc)

  • right to control the distribution of the work (eg. printing and reselling the artwork, sharing it through a paywall, etc)
